Installation Terms, Site Requirements & Permit Responsibility
By proceeding with your purchase and checking this box, you acknowledge and agree to the following terms with Summit Backyard Overstock.
1 Permits & Approvals
The customer is solely responsible for verifying and obtaining any permits, zoning approvals, HOA permissions, or other authorizations required by their city, county, municipality, or homeowners association prior to installation. Summit Backyard Overstock does not apply for, obtain, or verify permits on behalf of the customer and assumes no responsibility for permit requirements, zoning compliance, or HOA restrictions. Many outdoor structures under 100 square feet in the Denver area may only require a simple zoning permit; however, requirements vary by jurisdiction and property.
2 Site Preparation & Suitability
The customer is responsible for providing a reasonably level, stable installation area prior to the scheduled installation date. Installation surfaces may include patios, decks, compacted gravel, pavers, or other stable ground surfaces. Summit Backyard Overstock is not responsible for grading, landscaping, excavation, drainage correction, or structural ground preparation beyond minor leveling necessary for installation.
3 Access Requirements
The customer must ensure safe and reasonable access to the installation area for delivery and assembly. This includes adequate walkway clearance, gate access, and sufficient working space. If installers arrive and access conditions prevent installation, the installation may be rescheduled and additional service fees may apply.
4 Underground Utilities & Property Conditions
The customer is responsible for identifying and marking any underground utilities, sprinkler systems, electrical lines, septic systems, or other hidden property features that may be affected during installation. Summit Backyard Overstock is not responsible for damage to unmarked utilities, irrigation lines, landscaping, sod, or ground conditions during installation.
5 Post-Installation Responsibility
Once the structure has been delivered and installed, the customer assumes full responsibility for the structure, its placement, maintenance, and compliance with all applicable laws, regulations, and property restrictions. Summit Backyard Overstock is not liable for fines, enforcement actions, required relocations, or removals related to permits, zoning regulations, HOA requirements, or property restrictions.
6 Limitation of Liability
Summit Backyard Overstock shall not be held liable for any indirect, incidental, or consequential damages related to the installation or use of the structure once installation has been completed. The customer accepts the structure in its installed condition upon completion of the installation service.
